Office has further reported that neither undelivered envelopes returned nor acknowledgments received back. Besides this, none appeared on behalf of proposed respondents. Let notice be issued to the Superintendent Post Master, district Haridwar to enquire into the matter and submit the report whether the registered letter was served on the concerned party or not, and also what happened to the acknowledgments, which were tagged with the registered letter. Office, while asking comments of the Superintendent Post Master, district Haridwar, will also send the names and addresses of the proposed respondents and details of the registered letter, such as date of the registered post and post office from which it was sent.

Learned counsel for the appellant seeks permission to withdraw the claim petition filed before the Workmen's Compensation Commissioner, on the ground that the claim petition was filed before the Workmen's Compensation Commissioner on wrong advise and to permit the claimant to file the claim petition before the MACT.

Section 167 of Motor Vehicle Act give option either to file the petition under the Workmen's Compensation Act or under the Motor Vehicle Act.

Since appeal is in continuation of the trial court proceeding, therefore, permission is granted to withdraw the claim petition and the appeal stands disposed of with the direction that the appellant would be at liberty to file claim petition under Motor Vehicle Act.

Since the claim petition filed before Workmen's Compensation Commissioner has already been withdrawn, the order passed by the learned Commissioner shall not come in the way of claim proceeding.

It is provided if the tribunal comes to the conclusion that the appellant is entitled for compensation under the Motor Vehicles Act, the tribunal shall not grant any interest to the claimant for the delayed part.
